Although separation is colloquially known as ‘getting a divorce’, divorce is a separate legal process to formally recognise the permanent separation of the married couple. It is separate from a property settlement or a parenting dispute.
“When your marriage breaks down, it’s important that you get the help and support you need from people you can trust.”
Going through a divorce is an incredibly emotional time filled with uncertainty and anxiety. D’Angelo Lawyers will equip you with the knowledge you need to ease the anxieties of the ‘unknown’ and help guide you through the process.
In order to divorce your partner, you need to have been legally separated for at least 12 months.
To be eligible to apply for divorce in Australia you/your partner must:
Regard Australia as your home and place of residence.
Be an Australian citizen by birth, descent, or by a grant of Australian citizenship.
You will need to file an Application with the Court, along with a filing fee. Both parties do not need to consent to a divorce and if one party seeks a divorce, it is usually inevitable.
If you’re going through a separation and would like to discuss what the next steps might be, or if you should file for divorce, we can assist you.
We can help remove the stress and anxiety from the process.

For most families going through a separation or divorce, children are the number one priority.
